Income Tax : Delhi High Court Decides the Petition Challenging Vires of the CBDT Circular

In the recent case of Equity Intelligence AIF Trust v. CBDT [2025] GCtR 1401 (Delhi), the petition was filed challenging vires of CBDT Circular no.13/2014 dated 28.07.2014. Clarification contained in that Circular has been directed to be read down to conform to the analysis and conclusion of Delhi HC. 

It was held that no entity under any enactment can be perceived or compelled to perform the impossible.
