Wilful Defaulters by Banks : High Court Explains Basic Principles 

It has been held in PNB v. Nita Puri [2025] GCtR 1400 (Delhi) that a declaration of wilful default, within the meaning of the Master Circular, results in civil death. Strict compliance with the Master Circular, in scrupulous consciousness of its clauses and indicia is, therefore, the indispensable sine qua non. Unless the financial auditor is in possession of all facts and details, it cannot return even a tentative opinion on whether there has been diversion or siphoning of funds.
