Liability of Insurance Co. under EC Act, 1923

The case of UIIC v. Kamlesh [2017] GCtR 6355 (Delhi) is unequivocal, unambiguous and emphatic in its principle on cases under EC Act, 1923. The case answers whether a driver of an insured vehicle can be denied compensation and interest liability. This also answers whether any exoneration/recovery rights can be granted to insurance company by raising argument that murder cannot be said to be an accident. It was clearly held that "the word “use” in the context of a motor vehicle, has to be construed in a wider sense".
