Role of Lessee in Properties
The myth propagated is that people who are living in flats in Noida/Gr. Noida are owners of properties. What's the fact, since Noida has only allotted it on lease and there is no transfer of ownership ?
It was rightly held in Purushottam Das Bangur v. Dayanand Gupta [2012] GCtR 4502 (SC) that a lessee cannot be allowed to create a permanent structure on the property. Such construction will violate S.108(p) of Transfer of Property Act, 1882.
