Breach of Contract and Consequences of Law
While holding that Arbitral Tribunal can, in terms of Section 17 of the A & C Act, 1996 pass orders for interim measures of protection “in respect of the subject matter of the dispute”, it was also held in MORTH v. DSC Ventures Pvt Ltd [2015] GCtR 6385 (Delhi) that "in terms of S. 41 (e) of Specific Relief Act, 1963, no interim relief in order to prevent a breach of a contract which is otherwise not enforceable could be granted."
