Real Estate, Properties and Extent of Rights of Homebuyers under IBC, 2016
In case of Amit Nehra v. Pawan Kumar Garg [2025] GCtR 1485 (SC), where the homebuyer has preferred claim during proceedings under IBC, 2016 it was held that "the publication of the list of financial creditors is an act in discharge of a statutory duty by the Resolution Professional. It cannot be reduced to a meaningless formality." Ultimately, direction was issued to execute conveyance deed in favour of the homebuyer.
