Criminal Law : Contractual Violations and Extent of Criminal Liability under IPC

The case of Dalip Kaur v. Jagnar Singh [2009] GCtR 6369 (SC) is a clear answer on the issue related to S.420 of IPC, 1860. In this case, A sold property to someone else and did not returned money to B. It was held : "a pure and simple breach of contract does not constitute an offence of cheating."  "If the dispute between the parties was essentially a civil dispute resulting from a breach of contract on the part of the appellants by non-refunding the amount of advance the same would not constitute an offence of cheating."
