Repudiation of Insurance Claim and Its Legal Validity

In Inox World Pvt Ltd v. IFFCO Tokio General Insurance Co. Ltd [2025] GCtR 1581 (Delhi) it has been made clear that when there exists an arbitration agreement, then issue of validity/invalidity of repudiation of insurance claim by insurance company is to be decided by the arbitrator. So even if liability has not been admitted by insurance company but arbitration clause exists, the matter is to be referred for arbitration. 

  • S.11(4) of A&C Act, 1996 fixes time limit of 30 days.
  • S.11 (5) also fixes time limit of 30 days. 
  • S.11(7) prohibits filing of LPA. 
  • S.11 (13) requires disposal in 60 days. 
  • S.34 (3) fixes time limit of 3 months which can be extended to another 30 days but not thereafter.
