Driving Licence of Driver and Effect on Liability of Insurance Company under Motor Vehicles Act, 1988
In the case of Oriental Insurance Co Ltd v. Malta [2017] GCtR 6521 (Nagpur, Bombay) the effect of driving licence on compensation under MV Act, 1988 was answered. Merely because insurance company argues that driver did not have valid DL would not lead to exoneration or waiver of interest liability for the insurance company ; Order of MACT was upheld and appeal of insurance company was dismissed.
